July 2008 Texas Bar Exam is over

What did you think? Hard? Not too bad? Ready to take it again in the spring? Think you nailed it? What sections gave you fits and which ones were not too bad?

We like to know.

I thought that the MBE section was quite different from what I was used to from barbri. I also couln't believe they tested TWO freaking oil & gas quesions. And while I did answer them I thought the Art 9 question and the Flower/damages questions were wayyyyy too long!

The other stuff was ok, but I fear I may take it again in Feb....it didn't feel like my best performance and not quite was I was told to expect from barbri (which even with this comment I felt Barbri was WELL worth it.

MBE: I thought the evidence questions were ridiculous. Not at all similiar to the ones I was practicing with barbri or pmbr or adaptibar.

2 oil and gas questions! I really want to know how people answered the oil and gas questions cuz im afraid i bombed them.

The MPT was easy even though i did not finish it. I did not allocate my time properly. Too bad cuz the points shoulda been easy for that section.

The civ pr and crim pro was very similiar to the old ones.

Barbri was well worth it... they actually told us exactly which essays were going to be tested and in fact, they gave us the order of the essays. (except for the 2nd oil and gas)

btw.. did the lawyer get away with the inheritance??

1 of the oil and gas dealt with the "muscle in" provision of the TRRC Compulsory Pooling Act.

The other O&G dealt with adverse possession (and the severance of the mineral estate), constructive trust, and/or deed by estoppel.

I think the guy got the $500k since the decedent did not die intestate and the will prevails.

Just my opinions, and they could very well be wrong (crossing my fingers).

Oh yeah, and of course, the surface estate (and easements) are subservient to the mineral estate to the extent that the mineral owner must make "reasonable" accommodations for existing surface use.

Bleah!

Finally, with the price of oil +$115/barrel at the time of the test, I felt it prudent to study hell out of the oil and gas essays.
